Terms of Service

Welcome to 7fish.org (“Site”, “we”, “us”, or “our”). 7fish.org is a digital asset platform that provides downloadable design resources, including but not limited to images, illustrations, icons, templates, fonts, audio, video, and other creative materials (collectively, “Assets” or “Resources”). By accessing or using the Site, you (“User”, “you”, or “your”) agree to be bound by the following Terms of Service (“Terms”). If you do not agree with any part of these Terms, please discontinue use of the Site immediately.

1. Acceptance of Terms

By registering an account, browsing, downloading, or otherwise using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and 7fish.org.

2. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will become effective upon posting to this page, and the “Effective Date” will be updated accordingly. Your continued use of the Site after any modifications constitutes acceptance of the revised Terms. We encourage you to review this page periodically.

3. Account Registration and Security

3.1 To access certain features of the Site, including downloading Assets, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

3.2 You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 We reserve the right to suspend, disable, or terminate any account at our sole discretion, with or without notice, for conduct that we determine violates these Terms or is harmful to the Site, other users, or third parties.

3.4 Each account is for individual use only. Sharing account credentials with others or allowing multiple individuals to use a single account is prohibited unless expressly authorized under a team or enterprise plan.

4. Asset Licensing and Usage Rights

This section governs your rights to use any Assets downloaded from the Site. Please read it carefully.

4.1 License Grant

Subject to your compliance with these Terms and any applicable license agreements, 7fish.org grants you a limited, non-exclusive, non-transferable, and revocable license to download and use the Assets in accordance with the license type specified for each Asset at the time of download.

4.2 License Types

Assets on the Site may be offered under different license types, including but not limited to:

  • Free License: Assets available for download at no charge, subject to the usage restrictions outlined in Section 4.4 and any additional terms specified on the Asset’s download page.
  • Premium / Paid License: Assets available exclusively to paying subscribers or through individual purchase, which may grant expanded usage rights as specified on the Asset’s download page.
  • Editorial Use Only: Certain Assets are designated for editorial, educational, or personal use only and may not be used for commercial purposes.

The specific license terms displayed on each Asset’s download page shall prevail over any general terms in this section in the event of a conflict.

4.3 Permitted Uses

Unless otherwise restricted by the applicable license, you may generally use downloaded Assets for:

  • Personal, non-commercial projects (e.g., personal social media posts, wallpapers, hobby projects).
  • Commercial projects (e.g., marketing materials, website designs, advertisements, product packaging), subject to the specific license type applicable to each Asset.
  • Client work, provided the end product is a derivative work that incorporates the Asset in a substantially transformed manner.
  • Educational or academic projects.

4.4 Prohibited Uses

Regardless of the license type, the following uses are strictly prohibited:

  • Redistribution: You may not resell, sublicense, redistribute, share, or make available the original or minimally modified Assets — whether for free or for a fee — on any platform, website, file-sharing service, or competing stock/resource site.
  • Standalone Sale: You may not sell, license, or distribute the Assets (or derivatives that are not substantially transformed) as standalone files, clip art, stock resources, templates, plugins, or design elements.
  • Claiming Ownership: You may not claim authorship or ownership of any Asset, or register any Asset (or a substantially similar derivative) as a trademark, design patent, or copyright in your name.
  • Mass Downloading: You may not use automated tools, bots, scrapers, or scripts to systematically download, crawl, or collect Assets from the Site.
  • Unlawful or Harmful Content: You may not use any Asset in a manner that is defamatory, obscene, pornographic, illegal, or that promotes violence, discrimination, hatred, or any illegal activity.
  • Sensitive Contexts without Disclaimer: If an Asset contains identifiable persons or recognizable properties, you may not use it in a way that implies endorsement, or in connection with sensitive subjects (e.g., political campaigns, adult content, gambling, pharmaceutical advertising) without appropriate disclaimers.
  • AI/ML Training: Unless explicitly authorized, you may not use Assets as training data for artificial intelligence, machine learning models, or any generative AI systems.
  • NFT/Blockchain: You may not mint, tokenize, or sell any Asset as a non-fungible token (NFT) or blockchain-based digital asset without prior written permission.

4.5 Attribution

Certain Assets may require attribution to the original author or to 7fish.org. Where attribution is required, it will be clearly indicated on the Asset’s download page. You agree to provide proper credit in the manner specified.

4.6 License Revocation

We reserve the right to revoke your license to use any Asset if you are found to be in violation of these Terms. Upon revocation, you must immediately cease all use of the affected Asset(s) and destroy all copies in your possession.

5. Subscriptions and Payments

5.1 Subscription Plans

The Site may offer subscription plans or credit-based systems for accessing Premium Assets. Details regarding pricing, download limits, features, and billing cycles will be displayed on the relevant pricing or checkout page.

5.2 Billing and Renewal

If you purchase a subscription, you authorize us to charge your designated payment method on a recurring basis at the then-current rate until you cancel. Subscription fees are billed in advance and are non-refundable except as expressly stated in our Refund Policy (Section 5.4).

5.3 Price Changes

We reserve the right to change subscription pricing at any time. Price changes will take effect at the start of your next billing cycle. We will provide reasonable notice of any price increases.

5.4 Refund Policy

Due to the nature of digital goods, all sales are generally final. Refund requests will be considered on a case-by-case basis. If you believe you are entitled to a refund (e.g., duplicate charge, technical failure preventing download), please contact us within 7 days of the transaction.

5.5 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period, and you will retain access to Premium features until that time. No partial refunds will be issued for unused portions of a billing period.

6. Intellectual Property

6.1 Site Content

The Site itself — including its design, layout, code, logos, trademarks, and all non-Asset content — is the intellectual property of 7fish.org and is protected by applicable copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Site without our prior written consent.

6.2 Asset Ownership

Downloading an Asset does not transfer ownership of the underlying intellectual property. All Assets remain the property of their respective creators or rights holders. Your rights are limited to the license granted under these Terms and the applicable license type.

6.3 User Submissions

If you upload, submit, or contribute any content to the Site (e.g., comments, reviews, or Assets as a contributor), you grant 7fish.org a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, distribute, display, and create derivative works from such content in connection with operating and promoting the Site. You represent and warrant that you have all necessary rights to grant this license.

7. Content Accuracy and Availability

7.1 We strive to ensure all Assets are accurately described and properly categorized. However, we do not warrant that any Asset is free of errors, that descriptions are fully accurate, or that Assets are suitable for any particular purpose.

7.2 We reserve the right to remove, modify, or discontinue any Asset at any time without prior notice. The availability of any specific Asset is not guaranteed.

7.3 Certain Assets may include elements (e.g., fonts, plugins, or third-party components) that are subject to separate license terms. It is your responsibility to review and comply with any such third-party licenses.

8. Contributor Terms

8.1 If you are an Asset contributor or author on the Site, additional terms and agreements may apply. Contributor agreements will be provided separately and are incorporated into these Terms by reference.

8.2 Contributors represent and warrant that all submitted Assets are original works or that they hold sufficient rights to license them, and that the Assets do not infringe on any third-party intellectual property, privacy, or other rights.

9. DMCA and Copyright Infringement

9.1 We respect the intellectual property rights of others. If you believe that any Asset or content on the Site infringes your copyright, please submit a notice to us containing the following information:

  • Identification of the copyrighted work you claim has been infringed.
  • Identification of the material on the Site that you claim is infringing, with sufficient information to locate it.
  • Your contact information (name, address, email, phone number).
  • A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.
  • Your physical or electronic signature.

9.3 We reserve the right to remove any allegedly infringing content and to terminate accounts of repeat infringers.

10. Prohibited Conduct

In addition to the restrictions in Section 4.4, you agree not to:

  • Violate any applicable local, national, or international law or regulation.
  • Attempt to gain unauthorized access to any part of the Site, other user accounts, or connected systems.
  • Interfere with or disrupt the Site’s servers, networks, or infrastructure.
  • Circumvent, disable, or tamper with any security, access control, or digital rights management features of the Site.
  • Use the Site to transmit spam, unsolicited messages, or malicious software.
  • Misrepresent your identity or affiliation with any person or entity.
  • Reverse-engineer, decompile, or disassemble any software or technology used by the Site.

11. Third-Party Links and Services

The Site may contain links to third-party websites, services, or advertisements. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites. Your interactions with third-party services are solely between you and the third party.

12. Disclaimer of Warranties

THE SITE AND ALL ASSETS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, 7FISH.ORG DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

WE DO NOT WARRANT THAT: (A) THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; (B) ANY DEFECTS WILL BE CORRECTED; (C) THE ASSETS WILL MEET YOUR SPECIFIC REQUIREMENTS; OR (D) ANY ASSET IS FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, 7FISH.ORG, ITS OWNERS, OPERATORS, AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR BUSINESS OPPORTUNITIES — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR ANY ASSETS, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SITE OR THESE TERMS EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED US DOLLARS (USD $100), WHICHEVER IS GREATER.

14. Indemnification

You agree to indemnify, defend, and hold harmless 7fish.org, its owners, operators, affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site or any Assets; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights; or (d) any content you submit to the Site.

15. Privacy

Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal information. The Privacy Policy is incorporated into these Terms by reference.

16. Termination

16.1 We may suspend or terminate your account and access to the Site at any time, with or without cause or notice, including for violations of these Terms.

16.2 Upon termination, your license to use any Assets previously downloaded shall continue in accordance with the applicable license terms, provided you were in compliance with these Terms at the time of download. However, if termination results from a breach of these Terms, all licenses granted to you are immediately revoked.

16.3 Provisions that by their nature should survive termination shall remain in effect, including Sections 4 (Licensing), 6 (Intellectual Property), 12 (Disclaimers), 13 (Limitation of Liability), 14 (Indemnification), and 17 (Governing Law).

17. Governing Law and Dispute Resolution

17.1 These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict-of-law provisions.

17.2 Any dispute arising from or relating to these Terms or the Site shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within thirty (30) days, it shall be submitted to the exclusive jurisdiction of the courts located in [Jurisdiction].

20. Entire Agreement

These Terms, together with the Privacy Policy and any applicable license agreements or contributor agreements, constitute the entire agreement between you and 7fish.org regarding the use of the Site and supersede all prior agreements and understandings.
